Terms & Conditions for the Pre-Loved Millinery Marketplace

Welcome to the Pre-Loved Millinery Marketplace on www.beverleyedmondsonmillinery.co.uk ("the Platform"). By using this service, you agree to the following terms and conditions. Please read them carefully before listing or purchasing any items.
- About the Platform
1.1. Beverley Edmondson Millinery ("we", "us", "our") operates this online marketplace to facilitate the sale of pre-loved hats between private sellers and buyers.
1.2. We do not own, inspect, or sell the hats listed by sellers. We act solely as a facilitator.
1.3. All transactions occur directly between buyers and sellers. Our role is limited to providing the platform and processing payments.
- Seller Responsibilities
2.1. Sellers must accurately describe their items, including any defects, signs of wear, and materials used.
2.2. Listings must include high-quality images showing the actual item for sale.
2.3. Sellers are responsible for ensuring their items are clean and fit for resale.
2.4. Items must be packaged securely and dispatched within 7 days of sale confirmation.
2.5. Sellers must comply with all relevant UK laws regarding the sale of second-hand goods.
2.6. Counterfeit, replica, or unauthorised branded items are strictly prohibited.
2.7. Sellers must ensure they have copyright over the images that they post on the site.
- Buyer Responsibilities
3.1. Buyers acknowledge that pre-loved items may have signs of wear and should carefully review item descriptions and photos before purchase.
3.2. Buyers are responsible for reading and understanding the seller’s description.
3.3. By completing a purchase, buyers enter into a direct contract with the seller.
- Commission & Listing Fees
4.1. Sellers may list items for free, but a commission will be deducted from the final sale price:
- Standard commission: You will receive 70% of each sale and Beverley Edmondson Millinery will receive 30% per sale. Postage costs are the sellers responsibility
- Payments & Payouts
5.1. Payments are processed securely through a third-party provider (e.g., Stripe).
5.2. Sellers will receive payouts 7 days after delivery confirmation to allow for dispute resolution.
- Returns & Refunds
6.1. As items are sold by private sellers and are second hand goods, standard consumer protection laws regarding returns do not apply.
6.2. Returns are only accepted if the item is significantly misdescribed (e.g., incorrect size, undisclosed damage).
6.3. If a buyer believes an item is misrepresented, they must notify the seller within 48 hours of receipt.
6.4. The buyer is responsible for return postage unless otherwise agreed with the seller.
6.5. Refunds must be arranged directly between the buyer and seller. Beverley Edmondson Millinery is not responsible for issuing refunds but can assist in dispute mediation.
- Dispute Resolution
7.1. In case of disputes, buyers and sellers should first attempt to resolve the issue directly.
7.2. If an agreement cannot be reached, the Platform may mediate but is not obligated to enforce resolutions.
- Prohibited Conduct
8.1. Sellers must not list counterfeit, stolen, or illegal items.
8.2. Users must not engage in fraudulent transactions or attempt to complete sales outside of the Platform.
8.3. Sellers and buyers must not share personal contact details outside the Platform.
- Liability Disclaimer
9.1. Beverley Edmondson Millinery is not liable for:
- The quality, safety, or legality of items sold
- Delivery delays or postal issues
- Financial losses resulting from disputes between buyers and sellers
9.2. Our liability is limited to the amount of commission earned on any given transaction.
- GDPR & Privacy
10.1. Personal data will be handled in compliance with UK GDPR laws.
10.2. Sellers and buyers agree that their contact details may be shared with each other only for the purpose of completing transactions.
- Right to Remove Listings
11.1. We reserve the right to remove any listings that violate these terms or that we deem unsuitable for sale.
- Amendments to These Terms
12.1. We may update these terms from time to time. Continued use of the Platform constitutes acceptance of any changes.
